Monitoring the commitments under an investment agreement

This workbook organises the monitoring of investment agreement commitments, of the benefits received in return and of the supporting documents. Decree No. 2-23-1 indeed provides for the release of premiums in instalments and for the repayment of benefits in the event of a breach. The security of the benefits therefore depends on proof, at each deadline, of the investment made and of the jobs created and maintained.

Contents of the workbook for monitoring investment agreement commitments

  • An agreement sheet: parties, support scheme, amounts, planned stable jobs, completion period, amendments.
  • A register of commitments, each with an identifier, a deadline, an indicator, a supporting proof and a person responsible.
  • A schedule that calculates the alert dates and flags upcoming or overdue deadlines.
  • Monitoring of the investment made by item and of jobs, with calculated completion rate and stable headcount.
  • A statement of premiums and benefits received, a register of supporting documents and alert rules.
  • A Reporting tab: dashboard, register of open deviations, history of reports and exchanges.

When to use the workbook

The workbook serves from the signature of the agreement, then throughout the completion period. It accompanies in particular each request for the release of an instalment, the reports to the monitoring body and inspection visits. Investors that have signed agreements are its intended users. The person responsible for keeping the workbook and the deputy then update it at the set frequency.

Instructions for use

First, the user enters the parameters: frequency, alert notice period, completion threshold, stable job target, premium ceiling. Next, the user transcribes each commitment of the agreement without rewording, with its deadline and its supporting proof. The user then records invoices, jobs, premiums and documents as they arise. Finally, a periodic review reconciles the workbook with the accounts, the social security declarations and the agreement.

Expected outcome

Monitoring investment agreement commitments results in a dashboard: completion rate, stable headcount, premiums received, amount exposed to repayment. Deviations thus appear before the deadline, at a time when a notification or a request for an amendment is still possible.

Limitations

The workbook transcribes the text of the agreement without interpreting it; the scope of a disputed commitment is a matter for an authorised professional. Furthermore, adaptation to a specific agreement, review, validation and follow-up fall within consultations and packages. It contains neither an assessment of a specific situation nor representation. Employee data are subject to Law No. 09-08; the Jobs tab therefore uses pseudonymised identifiers. Management support tool, to be adapted to the organisation and to the applicable regulations.
