Drawing up the regulations governing the use of a collective mark

This template structures collective mark regulations, which govern the use of a collective mark or a collective certification mark serving a value chain. The regulations set out who may affix the sign, on which goods or services, under what control and with what consequences in the event of non-compliance. Law No. 17-97 further requires a certified true copy to accompany the filing application.

What the collective mark regulations template contains

  • An identification sheet: holder, sign, regime, Nice Classification classes, filing, reference specifications.
  • Fifteen articles, from the purpose of the regulations to their adoption and the list of annexes.
  • Provisions specific to each regime, marked “Option A” for the collective mark and “Option B” for certification.
  • Conditions of access and obligations of users, presentation and communication of the mark.
  • Control, three categories of breaches, the applicable measures and withdrawal of the right of use.
  • Governance by a mark committee, funding and an explanatory note on the options.

When to draw up collective mark regulations

The regulations are prepared before filing, since a copy accompanies the application. They also come into play upon amendment, which the holder notifies to the Moroccan Industrial and Commercial Property Office (OMPIC) for entry in the national register of marks. The choice between the two regimes nevertheless precedes drafting, as it determines the status of the holder and the method of control. Cooperatives, professional associations and territorial value chains are among their users.

Instructions for use

First, the holder chooses the regime using the explanatory note on the options. Next, the holder completes the entries in square brackets and deletes the provisions of the option not selected. Then the holder links the regulations to the specifications, the control plan, the breach grid and the graphic charter. Finally, the statutorily competent body of the holder adopts the regulations.

Expected outcome

The exercise results in draft collective mark regulations, linked to their annexes. Each common characteristic receives a verifiable formulation: threshold, measurement method, supporting document. Control thus has a precise object.

Limitations

The template does not replace the involvement of an industrial property attorney or a lawyer. This concerns in particular prior rights searches, filing, final drafting and defence of the mark. Furthermore, representation and adaptation to the specific case remain outside the scope.
